Limited Lifetime Warranty

AMISH MADE PRODUCTS, LLC 

LIMITED LIFETIME WARRANTY 

Amish Made Products, LLC (Sometimes hereinafter referred to as “Seller”) warrants that the products described in this warranty are free of defects and in workmanship and materials for the lifetime of the Purchaser.  

This warranty extends to the original purchaser of the product only. 

This warranty covers the following product only: Smokeless Firepit. 

1. In the event of a defect, malfunction, or other failure of the product not caused by misuse or damage while in the possession of the original purchaser, the Seller will remedy the failure or defect, without charge to the Purchaser, and at its option, either repair the defected product, or replace the product.  Any replacement product will be of equal, or similar value.  However, the Seller will not elect to refund the purchase price unless it is unable to provide a similar replacement and repair is not commercially practical, or feasible, or cannot be made within a reasonable time, or the purchaser is willing to accept such refund.  The purchaser must provide Amish Made Products, LLC with photos of the product’s defects for evaluation. Upon approval of warranty, Amish Made Products, LLC, may, in its sole discretion, issue a return for repair, or return for exchange of the defective product.

1. If the product, or one of its component parts contains a defect or malfunction, after a reasonable number of attempts by the Seller to remedy the defect or malfunction, the purchaser is entitled to either a refund, or replacement of the product of component parts, including free installation, at the Seller’s sole discretion.  

1. The term of the warranty begins on the date the product is purchased and delivered to the Purchaser and continues for the lifetime of the Purchaser.

1. This limited warranty does not cover failure to function caused by damage to the product while in the possession of the Purchaser, improper installation, unreasonable use or abuse of the product by Purchaser or its agents, failure to use the product in a proper fashion, improper maintenance by the purchaser of the product, failure to follow the written instructions provided with the product, or using the product for commercial purposes. This includes, but is not limited to, discoloration or damage to a patio or deck surface, furniture, house, or any other structure.

1.  This warranty is further limited to one (1) year from the date of purchase, by the original      purchaser, resulting from the Smokeless Firepit being exposed to saltwater or corrosion resulting from atmospheric conditions, high atmospheric humidity or salinity. 

THE REMEDIES PROVIDED IN THIS LIMITED WARRANTY ARE THE SOLE AND EXCLUSIVE REMEDIES AVAILABLE TO YOU AS THE PURCHASER.  THIS WARRANTY IS EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  NO OTHER EXPRESS OR ORAL WARRANTIES ARE MADE.  NO OTHER REPRESENTATIONS OR WARRANTIES SHALL BE BINDING UPON SELLER.  IN NO EVENT SHALL SELLER BE LIABLE OF ANY INCIDENTAL, CONSEQUENTIAL DAMAGES.  SELLER SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT INCIDENTIAL OR CONSEQUENTIAL DAMAGES EVEN IF SELLER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF SELLER HAS KNOWLEDGE THAT THE FAILURE TO PERFORM COULD CAUSE SUCH CONSEQUENTIAL ECONOMIC DAMAGES.  REGARDLESS OF ANYTHING CONTAINED HEREIN, THE CUMULATIVE DAMAGES FOR BREACH OF THIS WARRANTY ARE LIMITED TO THE AMOUNT PAID FOR THE PRODUCT AND MAY NOT EXCEED THE VALUE OF THE PRODUCT.  THIS APPLIES TO ALL ACTIONS RELATED TO THE PRODUCT, WHETHER BASED IN TORT, CONTRACT, OR OTHER LEGAL THEORIES.
